Terms and conditions of sale for ATAVISM RECORDS shop

Article 1 : Object
The General Terms and Conditions of Sale described hereinafter set forth the rights and obligations of ATAVISM RECORDS and its customer in connection with the sale of products :
- CD
- VINYLES
- TAPES
- MERCHANDISING
Any sale performed by ATAVISM RECORDS thus indicates that the purchaser has unconditionally accepted the present general sales conditions.
Article 2 : Price, shipping
1.1 Price
Prices for merchandise and services are those which are in effect on the day the order is accepted. The liabilities are denominated in euro, taxe inclued and without shipping
ATAVISM RECORDS grants itself the right to amend its rates at any time. However, it also agrees to bill merchandise that has been ordered at the price given at the time the order was recorded.
1.2 Shipping
Delivery costs depend upon the destination and the weight of the parcel.

Article 3 : Promotions
Price on all the shop inclued promotion that ATAVISM RECORDS would made in view of it's result or over reasons.
Article 4 : Discount
No discount will be granted in cases of prepayment.

Article 6 : Title clause
ATAVISM RECORDS preserves the ownership of the goods until the company has received in cash or cleared funds the effective payment in full for all goods.
For Bank Transfert and Bank cheque, customers dispose to a 10 days limit time to pay. Beyond this date ATAVISM RECORDS will not guarantee produce availability.
Article 7 : Delivery
Delivery will be done after recieving payment.
Delivery shall be effected by post to postal address given on the order.
The delivery deadline stated when the order is logged shall be intended for guidance purposes alone, and shall not be guaranteed in any manner whatsoever.
Accordingly, any delay in delivering the products shall not entitle the customer to damages or concel.
The customer shall bear the carriage risks in full until delivery.
ATAVISM RECORDS All our products have to pass a very strict quality control before shipping, in consequence, no return will be made.
Article 8 : Disponibility
Orders will be accepted while stock lasts.
Article 9 : Guarantees
In accordance to the French law, in case of damage or defects to products, ATAVISM RECORDS will promptly send a replacement after the damaged or defective product has been returned.

Article 11 : Major Forces.
The execution of the obligations of ATAVISM RECORDS in term of the presents is suspensed in case of emergence of a coincidence or a major force which would prevent the execution from it. ATAVISM RECORDS will inform the customers of the emergence of such an event as soon as possible.
As such, the major force gets on of any outside, unpredictable and irresistible event in the sense of the article 1148 of the French Civil code.
Article 12 : Competent juridiction
Any dispute relating to the interpretation and performance hereof shall be governed by French law.
If the dispute cannot be resolved out of court, it will be referred to the Instance Court of Chalon-sur-Saône.
Article 13 : Applicable Law
All clauses in these terms and conditions of sale and all sales and purchases to which they apply are governed by French Law.
